Fubara Has No Right to Withhold LG Funding - Wahab Shittu (SAN)

Wahab Shittu, a Senior Advocate of Nigeria, has said that Rivers State Governor Siminalayi Fubara has no legal authority to withhold the state's local government funding.

Fubara was charged by the state branch of the Association of Local Government Areas of Nigeria (ALGON) last week of withholding funds intended for the state's twenty-three LGAs.

According to the state ALGON, the governor's decision had deprived members of their function in the third-tier government's administration. The LG chairmen went on to say that Fubara's actions amounted to the state outlawing local government councils.

Analysing the allegation while speaking to journalists on Tuesday, Shittu stated that Fubara's behaviour was against the law in the country.

In conclusion, he stated that the constitution requires each state to create a legislation that corresponds to the system of democratically elected local government council areas. The Local Government Administration Law governs the creation, financing, organisation, and other relevant elements of local government in Lagos State. Thus, it is clear that Governor Fubara is not authorised by law to deny Ahoada Local Government or any other local government funding.
