The apex court fixed judgment in the appeal filed by Muhammad Barde of the People’s Democratic party against the governor for Friday.

The election petition tribunal and the Court of Appeal sitting in Abuja affirmed the election of the Gombe governor.

Not satisfied with the verdicts of the lower courts, the two parties and its candidates approached the apex court.

At the proceedings on Wednesday, counsel for the ADC candidate, Herbert Nwoye, denied a claim that his brief was filed outside the permitted time frame.

He insisted that his brief was filed on January 2 due to the new year public holiday, adding that he was served with the appellant’s processes on December 29.

Justice Kudirat Kekere-Ekun, who led the five-member panel, said he had until December 31 to file his brief.

She also held that the judge held the ADC candidate had about 1,000 votes but was trying to overload the court with its case.

“You can’t come to court with frivolous appeal. I think you should not waste our time,” the judge said.

Justice Kekere-Ekun, however, urged lawyers to advise their clients on cases they bring to court.

Nwoye subsequently opted to withdraw his appeal while Justice Kekere-Ekun dismissed the appeal.

The panel, after listening to the argument in the PDP’s matter, reserved judgment until Friday.
